Juvenile Prosecutions


The juvenile court system is probably the least understood part of the criminal justice system.  Juvenile Prosecutions hopes to provide an explanation of how a juvenile who commits a serious crime can be treated as an adult.   Juvenile Prosecutions provides the following information:

Age of Juvenile & Juvenile Court System

In Kentucky, any person under the age of 18 is considered a juvenile. Any juvenile who commits a crime is brought before juvenile court and prosecuted under Kentucky's Juvenile Code.

The purpose of Juvenile Court is different than the adult criminal justice system. The juvenile system, as it was originally intended 100 years ago, was designed to protect and rehabilitate wayward youths. Juvenile Court procedures were generally informal, confidential and not open to the public.

How Juveniles Can Be Treated As Adults

In years past, serious violent crime such as murder, assault, rape, robbery and arson were generally committed only by the most hardened criminals. They were frequently repeat offenders and almost always adults. Unfortunately, today, more and more of these vicious and terrifying crimes are being committed by juveniles.

As a result, Kentucky and most other states have provided a way for juveniles who commit serious crimes to be treated and tried as adults in the adult criminal justice system.

The Juvenile Court Judge can be requested, by the County Attorney, to transfer a juvenile/ out of juvenile court and to be treated as an adult in Circuit Court if a juvenile is charged with a serious crime or other circumstances exist. The Juvenile Court Judge would then hold a Transfer Hearing to decide whether the case met the legal requirements to transfer the case and treat the juvenile as an adult.

Circumstances Under Which Juveniles Can Be Treated as Adults

A juvenile can be treated as an adult under the following circumstances:

bullet A juvenile, age 14 or older, who is charged with a felony involving the use of a firearm;
bullet A juvenile, age 14 or older, who is charged with committing a Class A or B felony. (Class A & B felonies include: Murder, Rape 1st, Robbery 1st, Burglary 1st);
bullet A juvenile, age 14 or older, who is charged with any felony, and who has been transferred and convicted in adult court before;
bullet A juvenile, age 16 or older, who is charged with any felony, and has a prior felony adjudication (conviction) in Juvenile Court.
